Seeking specialist expertise to help defend a claim against you can ensure that your liability is minimised and a fair and appropriate level of compensation is negotiated with the claimant.

Our Personal Injury Team acts for private individuals, businesses and insurance companies to defend injury claims that have been brought against them. We have a proven track record of handling all types of accidents from initial liability enquiries, small and County Court claims through to High Court and contested cases in the Court of Appeal.

We have advised on claims arising from all types of accidents, including those supported by motor and household insurance policies, holiday and travel insurance, as well as cases where a source of funding is not available to defend claims.

At the outset of any claim, from the information given and evidence available, we will assess the prospects of defending the claim. We will advise on the likely value of the claim and whether it will be pursued as a small claim (up to £15k), a Fast Track claim (£5 - £15k) or a Multi Track claim (over £15k). This will enable us to advise on the likely costs of defending the claim and if successful, whether they are recoverable.

We will always seek to defend a claim without a Trial, but will advise defending Court proceedings if we believe this is necessary to minimise your liability or to enable you to contest the amount of compensation being pursued by the claimant. However, whether settling your case outside or through the Courts, we do not wish your case to last longer than is necessary.

If you are defending an accident that has happened within the last 3 years we offer an initial half-hour, obligation free meeting. We will ask you to explain the circumstances of your accident in order that we can:

  • Assess liability and advise on whether you have a case to defend; 
  • Advise on the likely success of defending your claim; 
  • Provide an indication of the costs involved; and 
  • Discuss insurances and other indemnities available to help cover the costs of your claim.

We will also explain the options available to fund your case, which include legal expenses insurance, motor insurance and home insurance policies. We will recommend the most suitable method of funding based on your circumstances.
