'Easement' is a legal term for a right over land granted in a legal document, whether that is in relation to pipes, overhead cables or access tracks. Examples include:
We act for landowners when negotiating deeds with utility providers such as National Grid Plc, Southern Electric or Southern Water. Our role is to ensure that the landowner's rights are protected. Documents must include essential provisions, for instance: 'a lift and shift' clause which allows for a land owner to demand that the supplier digs up and re-routes a pipeline if its position would jeopardise a grant of planning for development purposes.
A landowner may wish to grant a right of way to a neighbour or other individual over an access route. Again, such permissions require careful preparation once the fundamental terms have been agreed between agents for the parties. The landowner will want to protect against misuse of the right granted by, for instance, overuse by vehicles of an unanticipated nature or at inconsiderate times of the day. Such documents will also have to provide for other considerations, such as contributions towards maintenance and on what basis.
