Farm Business Tenancies & Grazing Licences

View of Fields and SheepUnder the existing legislation in respect of letting of farmland (the Agricultural Tenancies Act 1995), farmland can be let with specific notice periods for the termination of the tenancy, depending on the length of the initial term.  Both the landlord and tenant will want to consider:

  • The duration of the initial term (covering both the initial notice period and the obligation to register a tenancy with an initial term of more than seven years).
  • The landlord will want to ensure that the tenant complies with all legislation but particularly in relation to environmental matters because there may be the risk that the cost of remedying pollution of the land may fall on the landowner in the second instance, should the tenant default on his obligations.
  • The tenant will want to ensure that there are sufficient rights for access and service supplies and the landlord covenants to allow peaceful enjoyment of the property, subject to the tenant complying with his obligations.

In respect of grazing licences, the key concern for the landlord (Licensor) is to ensure that the tenant (Licensee) does not acquire rights of tenure and that the arrangement can be terminated at will.
