Health ChartIf you believe that you have suffered as a result of incompetence or substandard medical treatment you may be entitled to compensation. These cases tend to be of a more complex nature and involve difficult and sensitive issues. Potential clinical negligence claims also require detailed investigation as not all unsatisfactory outcomes are as a result of negligence.

Our clinical negligence team has successfully handled a number of compensation claims against hospitals, doctors, dentists and nurses. We recognise the sensitive nature of these claims and will deal with all claims sympathetically and professionally.

Trethowans holds a clinical negligence franchise from the Legal Services Commission, formerly known as the Legal Aid Board. This contract is only granted to firms which have proven experience in clinical negligence.
This enables us to act for clients who have Certificates of Public Funding (formerly known as Legal Aid Certificates) to pursue their clinical negligence claims. We are one of two practices in Salisbury and one of five in Southampton with a clinical negligence franchise. Chris Whiteley, Partner and Head of Personal Injury and Clare Carter, Associate and part of the Personal Injury Team are recognised members of the Solicitors Regulation Authority's Clinical Negligence Panel.

Keep a Diary
If you believe that you may have suffered from a medical accident, you should keep:

  • A diary of all events including dates of treatment, details of the treatment given, and medical advice given to you;
  • Copies of all correspondence and appointment cards from the doctor / hospital.

Some of the medical negligence cases we are handling currently or have recently settled include:

  • Currently acting on two ongoing birth injury cases (cerebral palsy), both with estimated total Damages of £7m and a further two cases estimated at £5m-£7m and £2m respectively
  • Acted for a Claimant (an infant) who experienced clinical negligence and subsequent shoulder/arm injury during her birth hospital (Erbs Palsy).  Settled for £235,000
  • Acted on a claim on behalf of a Claimant who underwent a below the knee amputation as a result of non-treatment of a minor fracture to a metatarsal.  Settled for £75,000
  • Acted on a claim on behalf of a Claimant who suffers from continued testicular pain and deep vain thrombosis as a result of negligent surgery.  Settled for £75,000
