Mental Incapacity
There are various ways in which relatives and friends can be appointed to manage the personal and financial affairs of those who are no longer capable of looking after their own affairs.
We can help with:
- Elderly Client Issues
- Lasting Powers of Attorney
- Receiverships / The appointment of a Deputy
- Tax Planning and Will writing for the Mentally Impaired
While you are fit and healthy, we can help you appoint one or more individuals, via a ‘Lasting Power of Attorney’ to manage your financial affairs and property on your behalf. These individuals do not usually assume control of your affairs straight away but remain on ‘standby’ and can take responsibility for your affairs if you become physically or mentally incapable of doing so yourself. For further details please refer to our page on Lasting Powers of Attorney.
If an individual becomes mentally incapable of managing their own affairs, and they have not previously chosen someone to manage them on their behalf via a Lasting Power of Attorney, an application will have to be made to the Office of the Public Guardian to appoint such a representative, known as a Deputy. In these circumstances we can assist with your application and help ensure it is promptly processed to enable you to take over the management of the individual’s affairs with the minimum of delay.
We recognise that cost issues are important to you and we are transparent about our fees. Before any work is undertaken we will outline what we propose to do on your behalf and provide you with written confirmation of our estimated total fees. We will consult you if the total fees are likely to exceed the original estimate and always provide an indication of the timescale it will take to complete your matter.
