Personal Injury
Our experienced Personal Injury Team, headed up by Partner David Healy, has a proven track record of advising clients across a range of compensation cases. David has dealt with many claims worth in excess of £1 million. In 2007 David settled one brain injury case for £4.5 million.
It may be an accident at work, a serious head injury, a car crash or simply a fall. Accidents take many forms and often permanently affect the lives of those involved. The majority of victims are entitled to compensation, but very few consider making a claim.
As David explains, “On a day to day basis we help individuals obtain compensation for injuries caused by someone else’s negligence, for example in a road traffic accident, an accident at work or through negligent medical treatment. Our job is to make sure that we get the individual enough money so that they can have a reasonable standard of living, particularly for individuals with catastrophic injuries where their world has been turned upside down and they need care for the rest of their life.”
We will always seek to reach a negotiated settlement but will resort to Court proceedings if we believe this is necessary to ensure our client receives a fair and correct amount of compensation. Securing the best possible outcome for our clients is our priority.
The Team is currently handling ongoing personal injury (excluding medical negligence) cases, worth £90m - £100m; and ongoing medical negligence cases worth £50m - £60m.
Some of the cases we are handling currently or have recently settled include:
- Settlement of spinal injury case (accident at work) for £2m
- Settlement of major head injury case (RTA), £4.23m
- Settlement of two head injury cases (both RTA) for £1.3m and £1m
- Currently acting on two ongoing birth injury cases (cerebral palsy), both with estimated total Damages of £7m and a further two cases estimated at £5m-£7m and £2m respectively
- Acted for a Claimant (an infant) who experienced clinical negligence and subsequent shoulder/arm injury during her birth hospital (Erbs Palsy). Settled for £235,000
- Acted on a claim on behalf of a Claimant who underwent a below the knee amputation as a result of non-treatment of a minor fracture to a metatarsal. Settled for £75,000
- Acted on a claim on behalf of a Claimant who suffers from continued testicular pain and deep vain thrombosis as a result of negligent surgery. Settled for £75,000
David concludes by saying, “My team fight litigation extremely effectively and have a proven record. We are conscious that clients are often going through very difficult changes in their life and we try to keep the litigation as straight forward as possible. Further problems can be caused by lack of funds and it is important to obtain interim damages”
We are recognised by the College of Personal Injury Lawyers and our specialist lawyers are members of the Law Society’s Personal Injury Panel and Clinical Negligence Panel, Headway Head Injuries Panel and the SIA Spinal Injuries Panel. Our particular areas of expertise include clinical negligence, head injury and spinal injury.
Upfront and ongoing costs are often reasons why people decide not to pursue a personal injury claim. However, there are a number of different methods that can be used to cover the costs involved. These include “no win, no fee” agreements, before and after event insurances. We will explain the various methods to you and recommend the most suitable method of funding based on your personal circumstances.
