Case Study 7 - Dental Negligence

Dental Negligence Case

Award: Â£2,250

Whilst receiving dental treatment a piece of metal (probably from a needle) was left in Mrs Roberts' gum which was causing her a great deal of pain and discomfort.

Mrs Roberts had to undergo a procedure to remove the metal which involved making an incision in the gum. Unfortunately, this left her with a large dent where the metal was located and caused this area of her gum to become numb to any sensation.

The claim was referred to Dental Protection, the professional body that deals with all claims on behalf of dentists. After some negotiation, the case was settled in July 2004 and Mrs Roberts was awarded Â£2,250 plus her expenses involved with pursuing the claim.

Trethowans accepted the claim on the basis that our costs would be kept to an absolute minimum as Mrs Roberts would not have been able to pursue the claim if any significant costs were incurred.

"Trethowans are absolutely fantastic. I had used them before this case and they were so lovely I went back. They were wonderful; Chris [Whiteley] was great and kept me up to date throughout the whole process." - Mrs Roberts, Southampton
