Case Study 8 - Medical Negligence
Clare Carter acted for a client who was claiming compensation because he had to have his lower leg amputated after his doctors delayed diagnosing him as suffering from ischaemia (reduction of blood flow) in his leg.
By the time he was diagnosed and treated, it was too late to save his leg. He had attended his doctors on a number of occasions complaining of symptoms and pain. However, his doctors failed to realise that he was suffering from ischaemia and so there was a delay before he was referred to hospital. He continued to deteriorate and when he was admitted to hospital for surgery, the surgeons could not save his leg. He was no longer able to work as a painter/decorator and his lifestyle was greatly changed by the amputation.
Clare Carter brought a claim on the client's behalf against his doctors alleging that they should have diagnosed his condition earlier and referred him for treatment earlier. Had they done so, we alleged that his leg would have been saved.
The Defendant doctors disputed the claim. The case went to a 5 day trial at which our client was successful. The Judge agreed with his claim that the doctors should have referred him to hospital earlier and that earlier treatment would probably have saved his leg.
After winning his case, our client now expects a six figure compensation payment for his injury, loss of earnings, assistance and equipment to help him.
