Accident at Work, Spinal Injury Case Study

Mr Phillip Glessing was a farm worker and was unhinging barn doors when the post and upper door collapsed onto him, knocking him backwards into a cattle feeder. He sustained a fracture of his vertebrae and a severed spinal cord, which left him paralysed from the waist down.  He is unable to walk and is dependent on a wheelchair for mobility. Read more >>>

The client was the driver of a vehicle involved in a road traffic accident which an articulated lorry pulled out in front of him without looking.  This caused a “severe impact” collision which resulted in multiple orthopaedic fractures and severe head injuries for the client. Read more >>>

Road Traffic Accident, Head Injury Case Study

The client was a rear seat passenger in a vehicle which was involved in a direct side impact with an oncoming car.  Amongst other injuries he suffered a major head injury that damaged the frontal and temporal lobes of the brain, which seriously affected his memory and cognitive abilities.  At the time of the accident the client was 18 years old. The client is an airman who was injured when he fell from a helicopter and sustained a severe brain injury.  Physically he is very strong but, from a brain injury perspective, he has been substantially limited in the periods for which he can concentrate and becomes fatigued very easily. Read more >>>

The client was involved in a road traffic accident in which his stationary vehicle was struck from the rear.  He sustained serious injuries in the accident and is now paralysed from the waist down.  Mr Woodrow was hospitalised from the date of the accident on 5 August 2005 until August 2006. Road Traffic Accident Case Study

Tom Hartigan acted for two clients following a fatal road traffic accident in September 2007. Mrs B and Mrs D were friends who were crossing the road in Amesbury that separated their respective houses. Both ladies completed their crossing and reached the pavement on the opposite side of the road. However, whilst standing on the pavement they were struck by a car which left the road and mounted the pavement. The driver had been drinking.  Read more >>>

Medical Negligence Case Study

David Healy acted for a client who was diagnosed with Cerebral Palsy. A claim in negligence was against a hospital on the basis of delayed treatment. It was eventually accepted by the hospital that the delay in delivery of the birth caused the baby perinatal asphyxia which led to brain damage. As a result the child (now a young lady) will be unable to work, is very vulnerable and will always require someone with her. Approximately 4 weeks before a trial listed for 1 week the matter was settled by way of a lump sum and yearly payment for the rest of the Claimant's life. The lump sum equivalent of the final award was £5.82m.

Case Study

David Healy acted for the Claimant who had a complaint against the Ministry of Defence for failing to diagnose an acoustic neuroma. This is a tumour in the brain which, if untreated, can cause a number of physical effects such as blindness, deafness and Bell's Palsy. The Claimant's primary allegations were that on three occasions the Defendant failed to notify him of an appointment to see an ENT specialist and on one occasion explicitly stopped the Claimant from attending. These acts were alleged to have taken place between 1995 and 1997. The Defendant alleged that as proceedings were not brought until 2005 that the claim was too time barred under the Limitation Act 1980. In July 2009 this matter came before the High Court for a decision as to whether the Claimant was out of time and could proceed with his claim. The court found that the Claimant was out of time under the Limitation Act 1980 as he failed to seek appropriate advice upon his discharge from the Army in 1997. However, the Court exercised its discretion under Section 33 of the Limitation Act in that, although the Claimant was out of time the Court found it just to allow the Claimant to proceed in any event. In making its decision the Court had regard to all of the circumstances and in particular any prejudice caused to the Defendant in respect of the lateness of the claim. This matter now proceeds on liability and quantum and is due to be heard in July 2010.
