Representing the Defendant via her European Insurers in connection with a road traffic accident in October 2008. The Claimant claimed that he had pulled out of a side road and was waiting for the traffic to clear in order that he could turn right when the Defendant failed to heed his presence and ploughed into the side of his car.
The Defendant’s evidence was that as she was proceeding along the road, the Claimant suddenly and without warning pulled out of a side road in front of her. She tried to swerve but was unable to avoid a collision. A counter claim was pursued for the repairs to her vehicle.
The Defendant travelled from France to give evidence at Trial. The Judge was impressed with her evidence and dismissed the Claimant’s case. He gave judgment in the Defendant’s favour and ordered that the Claimant pay the Defendant’s fixed costs and expenses.
