Representing the Defendant via European Insurers in connection with a road traffic accident in January 2009 and achieving a substantial saving on the settlement value of the claim.
The claimant suffered a back injury following a collision on a dual carriageway and it was found to have exacerbated a pre-existing degenerative cervical spine disease.
As a Managing Director of a group of companies and having been required to take time off work due to his injuries, the claimant advanced a substantial loss of earnings claim. This totalled over £250,000 and was in addition to the value of damages claimed for his personal injury.
Having obtained an expert report showing the extent of his pre-existing medical condition and undertaken investigations into his employment record we put forward a global offer in the sum of £20,000.
This settlement was accepted by the Claimant and represented an approximate 93% saving on the total amount initially claimed.
