The Banking and Finance Team act for banks, building societies, specialist lenders and also borrowers (both individual and corporate).
Specialists in acquisition finance
Our acquisition finance lawyers advise banks and borrowers on senior and mezzanine finance in relation to a wide variety of corporate transactions including debt facilities for corporate acquisitions, MBOs and MBIs and re-financing. We also advise on secured loans, complicated finance structures and inter-creditor issues.
Specialists in property finance
Our property finance expertise is drawn from our team of 18 commercial property lawyers. The team has considerable experience in acting for lenders funding businesses in the leisure, care, industrial property and pension property sectors. Last year our property finance experts acted for commercial lenders lending in the region of £100 million. Our approach is to ensure that we are recognised as an asset to the transaction. We provide a responsive commercial service.
Specialists in asset finance
Providing finance for car fleets, commercial vehicle fleets, mechanical handling equipment, printing equipment or other core business assets is a specialist area. We have advised both acquirers and funders in negotiations and prepared detailed documentation for many and varied transactions. Since 2006, we have assisted in the provision of asset finance having a value in excess of £250 million.
Specialists in financial services litigation
We have a depth of experience in financial services related litigation. We are regularly involved in conducting and recovery proceedings for our financial services clients. This includes investigating frauds perpetrated in asset and property based lending transactions, tracing assets and obtaining freezing injunctions to facilitate recoveries.
Nick Gent, Partner & Head of Banking & Finance comments; "Increasingly in this sector lenders and borrowers are looking for experienced commercially minded lawyers to put in place lending and security structures as quickly and cost effectively as possible. At Trethowans we understand this. Above all else, our clients require us to adopt a commercial approach and to provide clear advice and guidance on all aspects of a transaction. Our role is to solve problems and not simply identify them."
