The burden of empty rates liability could soon be a thing of the past following a recent High Court decision by Judge Jarman QC.
In a case involving cash and carry wholesalers Makro, the Court held that storing just 16 pallets of documents in an "empty" 140,000sq ft building was sufficient occupation to trigger the 6 month exemption from paying the rates.
This decision is a victory for landlords of empty properties and paves the way for a stream of relief claims based on minimal storage.
