Negligence solicitor Clare Carter specialises in clinical negligence and complex personal injury claims on behalf of Claimants who have been injured as the result of accidents or medical negligence.
Clare undertakes a wide variety of clinical negligence work including birth injury, orthopaedic, delayed diagnosis and treatment of injuries and diseases (including cancer), gynaecological, surgical, vascular, cardiac and brain injury cases. She acts for both adults and children. Clare has acted for clients who have been injured by negligent hospitals, doctors, dentists and other healthcare professionals. She has a particular interest in cerebral palsy birth injury cases and she acts on behalf of child Claimants with cerebral palsy in cases worth several million pounds.
Clare also acts for clients who have sustained severe injury as a result of road traffic accidents, accidents at work and other types of accidents. Clare's clients are often suffering from devastating injuries including head and spinal injuries.
Clare is a member of the Law Society's clinical negligence accreditation scheme (since 2007) and of the Law Society's personal injury accreditation scheme (since 2003). This demonstrates her expertise in these areas. She is also a member of APIL (Association of Personal Injury Lawyers) at senior litigator level and in 2012 she was also appointed to the AvMA clinical negligence panel.
Clare Carter is ranked in Band 1 of Chambers (2017), who recognise her as a market leader for claims of birth injury and cerebral palsy. Clare is also praised by Chambers for being particularly strong in the fields of gynaecological, paediatric, orthopaedic and surgical negligence - and is noted for focusing her practice on brain and spinal injury claims (resulting from road traffic accidents or accidents at work) and regularly handling high value cases involving catastrophic injuries.
Legal 500 (2016) states that Clare Carter is one of the Firm's standout practitioners as she ‘fights fiercely for clients’ on birth injury and cerebral palsy claims.
Examples of how Clare Carter has helped clients include:
- Clare acted for a Claimant who had to have his leg amputated due to the doctors' failure to diagnose ischaemia (restricted blood flow) and refer him for treatment earlier. The Defendants disputed liability but she pursued the claim on behalf of her client through a 5 day trial at which he was successful and subsequently recovered substantial compensation for his losses.
- Clare acted for a child Claimant who sustained injuries at birth and had cerebral palsy. It was alleged that there had been a delay by the hospital causing lack of oxygen. Compensation of a lump sum and substantial lifetime payments were recovered for the child.
