Our client sought our advice following a road traffic accident in Salisbury. He had sustained whiplash injuries.
He had received a letter from the other driver's solicitors alleging that our client had caused the accident by failing to stop at a red light causing injury to the other driver. However, he informed us that it was the other driver that had failed to stop at the lights and drove into our client causing him injury.
Therefore we requested the Police Accident Report and contacted an independent witness and took a statement from him. The independent witness confirmed that in fact the other driver had failed to stop at the red traffic light and drove into our client.
We then proceeded to notify the other driver's insurer and sent the witness evidence and medical evidence to them. We also sent a copy of the witness evidence to the solicitors acting on behalf of the other driver in relation to her personal injury claim against our client, after which the claim against him was withdrawn.
We went on to settle his claim and he received £2,850 in damages. We also recovered the vehicle outlay and excess on behalf of our client's insurers.
