Mr & Mrs R had a common problem. Both parties had been married before and both had children from that marriage.
They wanted to ensure that the survivor of them was able to stay in the home but that their respective children would ultimately benefit from the assets that had been accumulated during their lifetime. Roz Wyeth was able to prepare Wills whereby the survivor had a life interest trust in respect of the family home until his or her eventual death and then the asset passed to that one’s children following the death of the second.
This suited both parties as they could rely on the fact that they would not lose their home on the death of the first but that their respective children would eventually benefit. The trust within the Will was flexible enough to allow the survivor to move home as required while protecting the asset as appropriate.
