Case Study- Significant Personal Injury Claim Arising Out of a Road Traffic Accident.

James Braund, specialist Personal Injury and Clinical Negligence Senior Associate Solicitor at Trethowans LLP’s Poole Office, has recently concluded a significant personal injury claim arising out of a Road Traffic Accident.

In May 2017, Mrs C was struck by a vehicle while trying to cross the road, causing significant injuries.

As a result of the road traffic accident Mrs C suffered serious head injuries, pelvic fractures, facial injures, rib fractures, fractures to her lower spine and a shoulder fracture. As well as physical injuries, Mrs C also suffered from a period of delirium post pelvis operation leading to Post Traumatic Stress Disorder and significant memory issues.

Prior to Mrs C’s accident she was fully mobile; however, after her accident she was largely housebound. Her home had to be adapted, due to her injuries, including a stair-life being fitted.

Shortly after matters arose, Mrs C instructed James Braund, specialist Personal Injury and Clinical Negligence Senior Associate at Trethowans LLP, regarding a potential claim against the driver and insurance company of the driver, who struck Mrs C.

Appropriate investigations were undertaken and evidence gathered. In the meantime, significant further medico-legal evidence was obtained and the medical experts emphasised the severity and longevity of her injuries.

After some time, negotiations ensued and the claim was settled out of Court for a six figure sum.
