How long do I have to make a medical negligence claim?

As a general rule, you have three years from when medical negligence occurred to make your claim. There are exceptions; for example, you may not have been aware that medical negligence occurred until many years later. In these cases, you have three years from the point of becoming aware of the negligence and the damage caused to make your claim. This is known as the ‘date of knowledge’.

Children are another exception. If you are making a medical negligence claim on behalf of a child, you can do this at any point until they reach 18, at which point they will have three years to bring a claim themselves.

There is also no time limit for bringing a medical negligence claim on behalf of someone who lacks the mental capacity to do so themselves.
