EEA/Swiss nationals’ working rights change after 31 December 2020

What’s happening?

The EU transition period ends soon. EEA/Swiss nationals can no longer rely on EEA Free Movement rights after 31 December 2020.

Why is this relevant?

Existing free movement rights will lapse from 31st December 2020. As a result, all EEA/Swiss nationals must apply for UK immigration permission to remain in the UK. The EU Settlement Scheme (EUSS) is a programme specifically for EEA/Swiss nationals, enabling them to continue working and living in the UK. Otherwise they may face having to leave the UK. In other words, action will need to be taken.

What should you do?

  1.  Perform a staff audit: Identify who relies on EEA Free Movement rights.
  2. Ask staff to apply under the EUSS as soon as possible by clicking here. Waiting until the 30 June 2021 scheme cut-off date is unwise.
  3. Remind staff that their continued employment relies on gaining proof of right to live/work in the UK.
