Extension to SSP evidence requirements ends

What’s happening?

The temporary extension for employees to provide medical evidence of incapacity has now ended.

Why is this important?

The temporary extension meant employers could not require medical evidence of an employee’s incapacity until after 28 days had passed. See our original alert on the extension here.

The ending of this temporary extension means that for absences which start on or after today, employees can be required to provide medical evidence of their incapacity after 7 days.

What should you do?

  1. For any absences which started before today, you should not require employees to provide medical evidence of their incapacity during the first 28 days of their absence.
  2. For any absences starting on or after today, you can require medical evidence of incapacity after the usual 7 days of absence.
