Common Road Traffic Accident Injuries

Each year in the UK, thousands of road users are seriously injured in accidents. Whether you are suffering from polytrauma and fractures, or head and spinal injuries because of a road traffic accident, you may be able to make a claim to compensate for the pain and financial hardship your injuries have caused.

Brain and Head Injuries

As a consequence of a road traffic accident, a road user may develop a brain or head injury. This is most often a result of the head being hit or from hitting another object, but can also be caused by trauma from the brain hitting the inside of the skull. The extent of brain and head injuries can vary from mild to moderate, to severe.

Our lawyers are recognised and accredited by Headway (the brain injury charity) as specialists in dealing with claims involving head injuries.

Spinal Injuries

Significant road traffic accidents can also lead to serious spinal injuries, due to the forces placed on the neck and back during an accident. can include major soft tissue injuries, disc injuries, spinal fractures and incomplete or complete injuries to the spinal cord.

We work closely with the Spinal Injuries Association, as Business Members, reflecting our expertise in spinal injury claims.

Major Psychological Injuries

While psychological injuries caused by a road traffic accident may not be physically visible, they should not be overlooked or underestimated. Short and long-term psychological effects are common and can affect the person for the rest of their life.

Fractures

Fractures and broken bones are often the result of direct impact in a road traffic accident. For example, fractures can occur due to the impact of an airbag, steering wheel or other parts of the vehicle. Additionally, fractures can be caused by crushes and sudden or forceful blows, experienced in accidents.

Common Types of Road Traffic Accident Claims

There are many different types of road accidents that you may be able to make a claim for. If you have been injured in a road traffic accident that was someone else’s fault, our solicitors may be able to help you make a claim.

Car Accidents

Some of the most common types of car accidents include vehicle rollovers, single-car accidents, rear-end collisions, head-on collisions and accidents involving Heavy Goods Vehicles (HGVs) / other commercial vehicles. If you have been involved in a significant car accident that has caused damage or serious injury, you may be entitled to compensation.

Cycling Accidents

Bicycle accidents are common on the road and cyclists are among the most vulnerable road users. There are many types of bicycle accidents including accidents at junctions and roundabouts, motorists failing to see cyclists and dangerous driving.

Pedestrian Accidents

Pedestrians are the most at risk of being seriously injured in a road traffic accident due to a lack of physical protection on the road, which is heightened if the vehicle is a large vehicle (such as an HGV) or travelling at speed. The main causes of pedestrian accidents on the road include distracted driving, poor visibility, speeding, vehicles leaving the highway and failing to see pedestrians crossing roads.

Motorbike Accidents

Sometimes accidents involve motorcycles. The speed and power of modern motorcycles combined with limited protection afforded to motorcyclists, often mean that motorbike accidents can be significant. At Trethowans, we have a proven track record and significant experience in dealing with .

E Scooter Accidents

More and more people are using e scooters on the roads. As such, it is inevitable that there has been an increase in accidents involving e scooters. Like cyclists and pedestrians, e scooter users are vulnerable road users, due to the lack of protection, and can be subject to accidents involving motorists. In addition, other road users, particularly pedestrians, can be injured if struck by an e scooter, for example when crossing the highway, at junctions or on pavements.

Uninsured and Untraced Drivers

If you have been in an accident that was caused by an uninsured driver, you may still be able to make a claim for compensation. Accidents involving uninsured drivers and stolen vehicles are unfortunately quite common, but our solicitors are here to help bring a claim with the Motor Insurers Bureau (MIB). Some hit-and-run claims can also be pursued against the MIB, even if the vehicle cannot be traced, under the Untraced Drivers Agreement.

Road Traffic Accident FAQs

  • The law defines a road traffic accident as a collision involving a mechanically propelled vehicle on a road or public area. This means that a road traffic accident occurs when at least one vehicle is involved in an accident. A road traffic accident sometimes also includes pedestrians, cyclists, and motorcyclists. Even if all the criteria for a road traffic accident are not met, a claim may still be possible as a public liability claim.

  • Anybody who has been injured in a road traffic accident that was at least partly someone else’s fault can make a claim. This can include drivers, passengers, cyclists, pedestrians, and motorcyclists.

  • If you have been injured in a road traffic accident that was caused by someone else’s fault within the last three years you may be entitled to road accident compensation. There can be some exceptions, for example, in some claims, if you were under 18 years old at the time of the accident, this time period only starts to run when you turn 18.

There can be some exceptions, such as in claims at sea or fatal claims. However, a parent, close relative, or guardian can make a child’s personal injury claim, on their behalf, any time up to their 18th birthday.

  • We recommend you get in touch with a personal injury solicitor as soon as possible but you usually have three years to issue a formal claim with the Court from the date of your road traffic accident.

However, if you were severely injured and unable to claim after the accident for example, if you were in a coma or did not have capacity (for example if you had a severe brain injury or were in a coma), you will would usually have three years to claim from the date of your regaining capacity.

  • If you are partly at fault for causing a road traffic accident, you may still be eligible to make a claim. This is known as split liability or contributory negligence. However, if you are entirely at fault for causing the accident, in normal circumstances you will not be entitled to compensation from another driver.

  • We specialise in complex, high-value claims, involving significant injuries.

The amount you can claim for an injury depends on the severity of the circumstance. Compensation is provided to help injured individuals get back to the position they were in before the accident, so far as possible. Much will depend upon the exact level of the financial losses that have and will be suffered and the amount applicable for pain and suffering.

  • There is no set time for a claim to take. Complex cases can take much longer and can take a number of years. Factors that can impact the duration of your claim include the need for treatment or rehabilitation, the extent to which expert evidence may be required, available evidence, the severity of the injury and the approach being taken by the other side.
