Areas of Expertise
Case Study
Representing the proprietor of a Plant Hire company via his Public Liability Insurer. Successfully defending a claim pursued following an accident in which an excavator being driven by the Claimant tipped over, causing fracture injuries to his neck. Detailed witness evidence was obtained on behalf of the Defendant and forensic engineering was served that demonstrated that the accident couldn’t have occurred as alleged.
Representing a Dutch insurer in relation to a multi-party claim exceeding £1million arising from a road traffic collision on the M25. The insured’s vehicle was an articulated lorry that collided with the central barrier and the leg of an overhead gantry, causing the lorry to eject its load of large steel rolls onto the opposite carriageway where they hit multiple cars. All claims were repudiated on the grounds that the tyre failed as a result of a burst following an impact with a small unknown object a short distance prior to the collision with the barrier, and that there was nothing that the Defendant haulage company or its driver could have done to prevent the collision.
Representing the Defendant, a mixed arable farm partnership via its Public Liability Insurer. Successfully defending a claim at Trial for personal injury following a horse riding accident on a public bridleway. The Judge accepted that a bird scarer had spooked the Claimant’s horse but rejected the Claimant’s claim that the Defendant had negligently placed the bird scarer beside the bridleway.
