Case Study
I recently acted in a purchase of a Country house where a designated public footpath traversed the boundary wall and double brick garage, thereby obstructing the route of the public footpath. I obtained an indemnity policy covering obstruction of rights by providing the insurers with a statutory declaration sworn by the Seller, stating that no attempt had been made by the general public to use the footpath for more than 20 years together with the consent of the adjacent landowner for an application to be made for a formal diversion of the obstructed footpath.
The Buyer was advised that if left unresolved the Council could take enforcement action for the wall and the garage to be removed to enable unrestricted access over the designated footpath.
It was assessed that if this occurred it would result in a reduction in the value of the property by approx. £75,000.

Away from the office
In my spare time I enjoy country walks, tennis, skiing and generally keeping fit, but above all I love to spend time with my friends and family and, particularly at weekends, supporting my son’s sporting activities.
