Ian is the Head of the Commercial Litigation team based in Salisbury. He assists clients by providing practical advice on how to resolve issues that have arisen, either by representation in court proceedings or through ADR and mediation.
Areas of Expertise
Acted for landlord where tenant of long residential lease failed to pay service charges. Obtained order from court that the terms of the lease had been breached, and after serving S 146 Notice applied to the court and forfeited the lease. Landlord able to sell the leasehold interest again free of the tenants interest.
Members of a family were in dispute for a number of years over how to distribute property portfolio created by parents. Acted for one of the family members in mediation leading to agreement on distribution.
Client was entitled to his mothers estate under the terms of her Will. Other family member objected to the Will which excluded her and sought to rely upon much earlier Will. Proceedings issued and successful application made for summary judgement where terms of the last Will were upheld and costs were also awarded in favour of the client.
Will of relative left estate to client on trust. Trustees wanted to dispose of property without regard to the wishes of the client. Successful application for injunction to prevent sale and costs also awarded.
Former husband reached an agreement with client that upon his death a lump sum would be paid to reduce the level of her mortgage. No payment was made. After threatening to issue proceedings payment was made.
Client had agreed in consent order in matrimonial proceedings to pay maintenance to his former wife until she remarried. The payments went on for many years. After her death it emerged that since shortly after the consent order had been approved the former wife had begun to cohabit as a result of which she had received a substantial sum that she was not entitled to. Negotiated a settlement with the Estate leading to return of monies to client.
Away from the office
Ian lives with his family in Salisbury, enjoying walking, crime thrillers and tinkering in his shed. He also sits as an Assistant Coroner for Wiltshire & Swindon
