Five things your family solicitor wants you to know when you are going through a divorce

Rosie Beaven provides a list of the five things your family solicitor will want you to know when you are going through a divorce.

Family law can be an emotional rollercoaster – a mix of sadness, anger, hope and worry. While your solicitor won’t necessarily be able to smooth away all those ups and downs, they can help make sure you arrive at the best possible destination.

1. You are not alone

The breakdown of a relationship can feel like an emotional rollercoaster, especially during the Covid-19 pandemic. It is important to build a strong support system for you and for your children. Instructing a solicitor you feel comfortable with is an important first step. Laura Bell gives her advice on building a solid support system here.

2. Court usually isn’t how you imagined it to be

Contrary to popular belief, there is no requirement to attend Court for divorce proceedings or to deal with the finances when getting divorced. In fact, it is often a last resort when you cannot reach an agreement. Judges, along with other legal professionals, will encourage you to reach an agreement outside of the Court room. Many people wish to have ‘their day in Court’ but more often than not, this does not turn out to be quite how they imagined it.

3. Honesty is the best policy

By being open and honest with your solicitor, you are making sure that they have the full picture which will ultimately help them to help you. With all the right information, your solicitor can guide you through the legal complexities and tailor their advice to your unique situation.

4. Teamwork makes the dream work

Throughout the process you may need specialist advice from other professionals such as Independent Financial Advisors, mortgage brokers and pension experts. Building your team of professionals who can work together with you and your solicitor can help make the process smoother.

5. This too shall pass

Divorce isn’t always a quick process but once the legalities are finalised and the finances resolved, the outcome should allow you to move on with your life with certainty.
