Contracts were a key requirement for all businesses, ranging from low‑risk and low‑value contracts to pivotal revenue‑generating contracts with key customers, as well as supply agreements for goods and services fundamental to the operation of the business. In the New Year, we looked back at what we learned from 2025’s key contract challenges and disputes so these lessons could be adopted in future contract reviews.

We were joined by special guest speaker Keith Markham, who qualified as a Solicitor in 2001 and worked in both private practice and in‑house roles, including at comparethemarket.com, one of the UK’s leading price comparison websites. Drawing on his extensive practical experience, Keith had been providing professional development training on various aspects of commercial law since 2007.

Louise Thompson, Partner at Trethowans, also shared insights on emerging trends in Data Processing Agreements (DPAs), including the increasing instances of IT vendors seeking to use customer data more broadly, positioning themselves as controllers rather than processors, and the growing practice of incorporating DPAs via hyperlinks in contracts.

This session was designed for in‑house legal counsel, procurement and contract managers, data protection and compliance professionals, and business leaders who dealt with English law contracts.
