Trethowans Insurance & Regulatory team is renowned for its expertise in defending claims with an international element.
In this case, the team were instructed by Flyct B.V. to represent the interests of their Dutch insured and legal expenses insurance provider. The case involved a claim exceeding £100,000, brought in relation to alleged non-payment in relation to a prolonged hotel stay, spanning two separate periods over three months, at a luxury hotel in London.
The claim was brought against two Defendants. The first Defendant who was alleged to have contracted to pay for the hotel charges, and our client (the second Defendant) who had stayed at the hotel under the same booking. It was alleged that our client was liable in restitution on the basis that he had been unjustly enriched to the detriment of the Claimant hotel.
Trethowans robustly defended the claim. Ultimately, the Claimant decided to discontinue the proceedings, resulting in the Claimant being liable for our client’s legal costs.
