£350,000 Settlement for Life‑Changing Workplace Head Injury: Personal Injury Claim Success
Frances Gillett, assisted by Katherine Knapman of Trethowans LLP acted on behalf of a client in relation to a personal injury claim arising as a result of injuries the client sustained in an incident at work.
As a result of the incident the client sustained a head injury. She experienced issues with her cognition, including memory and concentration difficulties, as well as fatigue and audiovestibular issues.
Medical evidence was obtained from various experts including a neurologist, neuropsychologist, neuropsychiatrist and audiovestibular expert. The client’s symptoms were life changing and permanent.
As a result of the client’s injuries, she could not continue with her employment and is unlikely to work full time basis in the future. She required rehabilitation treatment and ongoing care and assistance from her family.
Liability was disputed by the solicitors for the defendant’s employer throughout the claim. Court proceedings were required to continue with the claim beyond the three-year limitation period. A settlement of the claim was achieved prior to a Trial, and the client received a total settlement of £350,000. The settlement included compensation for physical, cognitive and psychological injuries as well as financial losses, both past and future, including loss of earnings, loss of pension, medical expenses and care and assistance.
