Six-Figure Award Achieved for Client Following Traumatic Head Injury

Frances Gillett and Katherine Knapman of Trethowans LLP acted on behalf of a client in relation to a claim arising as a result of a violent crime where the client was assaulted.

The claim arose from an incident in which the client was in Manchester during an evening out and he intervened in a fight and was punched by two men causing him to fall to the ground and hit his head.   He was knocked unconscious and sustained a significant head injury.  He was taken to hospital and was put in an induced coma, had a tracheostomy and required surgery.   He eventually came out of the coma and underwent intensive rehabilitation treatment whilst in hospital and in a brain injury clinic.   He also experienced seizures and was at risk for future seizures.

The client sustained life changing injuries and experienced ongoing cognitive issues.  As a result he required care and assistance, ongoing treatment and was unable to work.

The client was assessed as not having capacity due to his head injury and so his daughter gave instructions on his behalf in relation to the claim.

The claim was submitted to the Criminal Injuries Compensation Authority who deal with claims on behalf of victims of violent crimes.

Medical evidence was obtained from a neuropsychologist and care expert. 

The CICA awarded the client a significant six figure award. The compensation claimable under the Criminal Injuries Compensation Authority is limited accordingly to specific tariffs and categories for injuries and losses.  

The client’s daughter commented:
