Clementine is an Associate in the Dispute Resolution Team in Southampton. Her practice covers all manner of commercial contract disputes including professional negligence, construction disputes, director/shareholder disputes, high value debt recovery and defamation. Clementine acts for commercial clients, including litigation funders, and private individuals in County Court and High Court proceedings as well as conducting her own advocacy in the County Courts.
Notable work highlights
- Assisting lead Partner in the reported case of Fattal v Fattal [2022] EWHC (Ch) which involved a claim relating to co-ownership of a property and proprietary remedies.
- Acting for a litigation funder in a High Court claim against directors for breach of director’s duties worth £250,000 which settled at mediation shortly before trial.
- Representing a Claimant in County Court proceedings and successfully opposing a relief from sanctions application resulting in judgment awarded in the Claimant’s favour with full costs recovery.
- Successfully defending a claim against a telecommunications company at trial concerning a claim for misrepresentation resulting in a judgment for full recovery of their costs.
- Acting for a client in a multi-party dispute concerning a claim for an injunction by a director relating to breaches of director duties.
- Assisting Partner in a multi-million pound High Court finance litigation claim concerning misuse of confidential information.
- Advising employers and contractors on payment disputes concerning interim valuations and final accounts in construction contracts
- Restoring companies to the register through Part 8 court proceedings in order to recover monies and sell property.
- Experience in representing individuals in professional negligence claims against Solicitors.
- Successfully negotiating and recovering debt in the sum of £500,000 from a global boat builder on behalf of Liquidators for a company in creditors voluntary liquidation.
